GENERAL TERMS
Flatout Editions are curated, limited-capacity driving experiences operated by FLAT-OUT TOURS LTD.
These General Terms outline how bookings are confirmed, how payments and cancellations are handled, and the responsibilities that accompany participation. They also explain the structure under which each Edition is delivered.
Participation in a Flatout Edition is subject to acceptance, confirmed booking and adherence to the standards set out below.
By registering, booking or taking part in an Edition, you agree to these Terms.

These General Terms govern the use of the Flatout website and the booking of, and participation in, any Flatout driving edition or related event (each an “Edition”).

References in these Terms to “Flatout”, “we”, “us” or “our” are to FLAT-OUT TOURS LTD.
By accessing this website, submitting an enquiry, registering interest, paying a deposit, or participating in any Edition, you acknowledge that you have read, understood and agree to be bound by these Terms.
If you do not agree to these Terms, you must not use this website or book or participate in any Edition.
These Terms apply to all website users and all participants. Where additional booking information, itineraries, payment schedules or event-specific details are provided, they form part of the contractual agreement between you and Flatout.
A binding contract between you and FLAT-OUT TOURS LTD is formed when we confirm your place on an Edition in writing and receive any required deposit.
We reserve the right to update or amend these Terms from time to time. The version in force at the time your booking is confirmed shall apply to your participation.
These Terms, and any non-contractual obligations arising out of them, are governed by the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction to resolve any dispute arising in connection with them. -
The content of this website, including but not limited to text, imagery, photography, video, graphics, logos, branding, itineraries, route concepts and design elements, is owned by or licensed to Flatout and is protected by copyright, trademark and other intellectual property laws.
All rights are reserved.
You may access and view the website for personal, non-commercial use only. You may not copy, reproduce, modify, distribute, republish, transmit, display, or otherwise exploit any part of this website or its content without our prior written consent.
In particular, the use of any Flatout imagery, photography, branding, edition concepts, route descriptions or event materials for commercial purposes, promotional activity, or reproduction in any form is strictly prohibited unless expressly authorised in writing.
You must not use this website in any way that:is unlawful or fraudulent;
infringes the rights of any third party;
introduces malicious code or interferes with the operation or security of the website; or
attempts to gain unauthorised access to any part of the website or its underlying systems.
We make reasonable efforts to ensure that information provided on this website is accurate at the time of publication. However, all content is provided for general information purposes only and may be updated or amended without notice.
Access to the website is provided on an “as available” basis. We do not guarantee uninterrupted or error-free operation. -
Flatout Editions operate on a limited-capacity basis. Places are strictly limited and allocated at our discretion.
Submission of an enquiry or registration of interest does not constitute a confirmed booking and does not create a contractual relationship.
Following registration, we may provide further details, including itinerary, pricing and participation requirements. A place on an Edition is confirmed only when:we have confirmed acceptance in writing; and
the required deposit has been received in cleared funds.
We reserve the right to decline any application or registration at our discretion, including where the number of applicants exceeds available places or where we consider that participation would not be appropriate for the Edition concerned.
Where an application is not accepted due to capacity limitations, we may, at our discretion, offer priority consideration for a future Edition. Such priority does not guarantee a place.
Each booking is personal to the named participant and may not be transferred without our prior written consent. -
A deposit of 40% of the total Edition price is required in order to secure a confirmed place on an Edition.
No booking is confirmed until the required deposit has been received in cleared funds and written confirmation has been issued by Flatout.
The remaining balance of the total Edition price is due no later than 60 days prior to the scheduled departure date.
Where a booking is made within 60 days of the scheduled departure date, the full Edition price is payable at the time of confirmation.
All payments must be made in accordance with the instructions provided at the time of booking. Payments may be processed through a third-party payment platform acting on our behalf. Your contractual relationship remains with FLAT-OUT TOURS LTD.
If any balance payment is not received by the due date, we reserve the right to treat the booking as cancelled by you and to retain any sums already paid in accordance with the cancellation provisions set out below.
All prices are stated in GBP unless otherwise specified. -
If you wish to cancel your participation in an Edition, you must notify us in writing.
The date on which written notice of cancellation is received by us will determine the applicable cancellation terms.
Where your booking has been made via Ticketebo, the purchase of tickets is also subject to the provisions set out in Clauses (A) and (B) below. Any booking fees, card charges or other third-party fees applied via the Site are non-refundable except where required by law.
Cancellation charges are as follows:
More than 60 days prior to the scheduled departure date
The 40% deposit is non-refundable. Any additional sums paid above the deposit will be refunded.
60 days or fewer prior to the scheduled departure date
All payments made are non-refundable.
Places on each Edition are limited and cancellations may affect the viability of the event. The above cancellation terms reflect the administrative, logistical and supplier commitments incurred by Flat-Out Tours.
If, following your cancellation, we are able to resell your place on the Edition, we may, at our sole discretion, refund any sums recovered from the replacement booking, less any unrecoverable costs, third-party fees (including Ticketebo fees where applicable) and reasonable administrative expenses. We are under no obligation to resell any cancelled place.
Participants are strongly advised to obtain comprehensive travel insurance at the time of booking, including cover for cancellation.
Clauses (A) and (B)
(A). Tickets purchased on the Site are subject to a non-refundable per order booking fee which may, at the option of the event organiser, either be identified separately to you or included in the ticket price. In some cases, delivery prices and credit card surcharges will also be clearly identified and charged.
(B). Unless stated to be otherwise, charges referred to for any tickets or registrations supplied via the Site are stated inclusive of VAT where relevant. A tax invoice will be provided to you upon completing your purchase of tickets (where relevant). VAT means Value Added Tax which is a tax added to the value of goods in the UK (Currently this is 20%). Your tax invoice will clearly show the break down of VAT chargeable.

Participation in a Flatout Edition involves travel by road in privately owned vehicles. Each participant acknowledges that driving on public roads carries inherent risks.
By booking and participating in an Edition, you agree that:• You hold a valid driving licence appropriate for the vehicle you are operating and for the jurisdictions in which the Edition takes place.
• You are legally entitled to drive in the relevant countries.
• Your vehicle is roadworthy, properly maintained and compliant with all applicable legal requirements.
• You hold valid and comprehensive motor insurance covering the full duration of the Edition, including travel in all relevant jurisdictions.
• You are responsible for ensuring that your insurance policy does not exclude participation in organised driving events or cross-border travel where applicable.Flatout does not provide motor insurance, vehicle insurance or personal accident insurance for participants. You are solely responsible for ensuring that you have appropriate insurance cover in place.
Participants drive independently and at their own discretion at all times.
Participants acknowledge that they voluntarily assume the inherent risks associated with road travel and participation in an organised driving experience.
You are solely responsible for:
• The operation and control of your vehicle;
• Compliance with all applicable traffic laws and regulations;
• Any fines, penalties, tolls or charges incurred during the Edition;
• Any damage to your own vehicle;
• Any damage caused by you to third parties or to their property.
Flatout does not accept responsibility for:• Any accident, collision or incident occurring during an Edition;
• Mechanical failure, breakdown or damage to any participant vehicle;
• Loss of or damage to personal property;
• The acts or omissions of other participants, road users, third parties or service providers.
Participation in an Edition may be subject to the completion of a separate risk acknowledgement and participation waiver prior to departure. Where required, participation is conditional upon receipt of a signed waiver in the form provided by Flatout.Failure to provide a completed waiver within the timeframe specified may result in cancellation of your participation without refund.
Participants are expected to conduct themselves in a safe, responsible and respectful manner at all times. We reserve the right to remove any participant from an Edition, without refund, where their behaviour is unsafe, unlawful, or materially detrimental to the experience of others.
Flatout organises curated driving experiences and does not provide driving instruction, supervision of vehicle operation, or competitive motor sport activity.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability which cannot lawfully be excluded or limited under applicable law.
Subject to the above, Flatout’s total liability to you arising out of or in connection with your participation in an Edition, whether in contract, tort (including negligence) or otherwise, shall be limited to the total amount paid by you for the relevant Edition.
Flatout shall not be liable for any indirect or consequential loss, including (without limitation) loss of enjoyment, loss of opportunity, loss of profits, loss of vehicle use, or additional travel or accommodation expenses incurred outside the scope of the Edition.
Flatout acts as organiser of curated driving experiences and may engage third-party suppliers. While we take reasonable care in selecting such suppliers, we shall not be responsible for their acts or omissions.
Participants acknowledge that participation is undertaken voluntarily.

Flatout shall not be liable for any failure to perform, or delay in performing, any obligation under these Terms resulting from events beyond our reasonable control.
Force Majeure Events may include natural disasters, extreme weather, war, threat of war, armed conflict, terrorism, civil unrest, government action, travel restrictions, border closures, epidemic, pandemic, strikes, road closures, transport disruption or supplier failure.
Where such events occur, we may modify, postpone or cancel the Edition.
In the event of cancellation due to a Force Majeure Event, refunds will be limited to amounts recovered from third-party suppliers, less unrecoverable costs reasonably incurred. Flatout shall not be liable for any additional costs, losses or expenses incurred by participants as a result of such events.
Participants are responsible for obtaining appropriate travel insurance.

Flatout Editions are documented through photography and video.
By participating in an Edition, you grant Flatout a worldwide, perpetual, royalty-free licence to use media captured during the Edition for promotional and commercial purposes.
No compensation shall be payable.
If you do not wish to appear in identifiable media, you must notify us in writing prior to departure. -
If any provision is invalid, the remaining provisions remain in force.
No failure or delay by Flatout constitutes a waiver.
You may not transfer your booking without consent.
These Terms constitute the entire agreement between you and Flatout.
No variation is effective unless agreed in writing.
Nothing in these Terms confers rights on third parties under the Contracts (Rights of Third Parties) Act 1999.
